Terms & Conditions

Please read these Terms and Conditions carefully before making a booking. By confirming a booking with Karmasky Travels Ltd, you agree to be bound by these terms. These terms form the basis of your contract with us.

1. Bookings & Confirmation

A booking is confirmed only upon receipt of the required deposit (30% of the total package price) and our written confirmation. Verbal or email commitments made prior to deposit payment do not constitute a binding booking. We reserve the right to decline any booking at our discretion. Once a booking is confirmed, any subsequent changes or additions are subject to availability and may incur amendment fees.

2. Payments

A non-refundable deposit of 30% of the total package price is required at the time of booking. The balance is due no later than 60 days before your departure date. For bookings made within 60 days of departure, full payment is required at the time of booking. We accept payment by credit/debit card, M-Pesa, or international bank transfer. All prices are stated in USD unless otherwise agreed. We reserve the right to pass on any bank charges for international transfers.

3. Cancellation by You

All cancellations must be made in writing. The following charges apply from the date your written cancellation is received: • More than 90 days before departure: Loss of deposit only • 60–89 days before departure: 25% of total package price • 30–59 days before departure: 50% of total package price • 0–29 days before departure: 100% of total package price These cancellation charges apply to the full package price, not the deposit amount. We strongly recommend comprehensive travel insurance that includes cancellation for any reason coverage.

4. Cancellation by Karmasky Travels

We reserve the right to cancel any booking in the event of insufficient numbers for a scheduled group departure, or for reasons beyond our reasonable control. In such circumstances, we will offer you an alternative departure, a credit note valid for 24 months, or a full refund of all monies paid to us. We will not be liable for any additional costs incurred (such as international airfares) in the event of such cancellation.

5. Pricing & Changes

Our prices are based on costs prevailing at the time of publication. We reserve the right to amend prices in the event of significant changes in fuel costs, exchange rates, park fees, or taxes. Price increases of less than 2% will be absorbed. Price increases of 2% or more will be notified to you in writing. If a price increase exceeds 8% of the total package price, you may choose to cancel with a full refund. We guarantee no price increases after full payment has been received.

6. Force Majeure

We cannot accept liability for any loss, damage, delay, or cancellation caused by events of force majeure — including but not limited to acts of God, natural disasters, acts of war or terrorism, epidemic or pandemic, government travel restrictions, industrial action, or any other event beyond our reasonable control. In such circumstances, we will endeavour to find a suitable alternative or offer a credit for future travel, but we cannot guarantee a refund of costs we have been unable to recover from our suppliers.

7. Our Liability

We accept responsibility for the proper performance of our obligations as a travel company, subject to these Terms and Conditions. Our liability to you is limited to twice the price of the affected component of your package. We do not accept liability for: any injury, illness, death, loss, damage, or expense caused by circumstances beyond our control; any injury, illness, or death arising from activities inherently dangerous in nature; the acts or omissions of third party suppliers where they could not have been avoided even with reasonable care.

8. Travel Insurance

Comprehensive travel insurance is strongly recommended and considered essential for all our journeys. At minimum, your policy should include: emergency medical treatment, emergency medical evacuation (minimum $500,000 coverage), trip cancellation and curtailment, loss of personal belongings, and personal liability. We are not responsible for any costs or losses you incur that would have been covered by adequate travel insurance.

9. Passports, Visas & Health Requirements

You are solely responsible for ensuring you hold a valid passport with sufficient validity (minimum six months beyond your return date), all required visas, and any required vaccinations or health documentation. We will provide general guidance on requirements, but this does not constitute legal or medical advice. We accept no liability for any costs, delays, or losses arising from your failure to comply with entry requirements.

10. Travel Risks & Your Responsibilities

You acknowledge that travel to African wildlife destinations involves inherent risks, including but not limited to: exposure to wildlife, remote locations with limited medical facilities, outdoor activities in challenging environments, and unpredictable weather conditions. By booking with us, you confirm that you have assessed these risks and accept them. You agree to follow all safety instructions provided by our guides and camp staff. Failure to do so may result in removal from the programme without refund.

11. Accommodation & Services

All accommodation is subject to availability and may be substituted with properties of equivalent or superior standard without prior notice if circumstances require. Room and tent allocation is at the discretion of the property. Check-in and check-out times are determined by each property. We cannot guarantee specific room numbers, locations, or views unless expressly agreed in writing.

12. Disputes & Governing Law

We will endeavour to resolve any complaint promptly and fairly. Any dispute arising from these Terms and Conditions shall first be subject to mediation. If mediation fails, disputes shall be subject to the exclusive jurisdiction of the courts of Kenya. These Terms and Conditions are governed by the laws of Kenya. Nothing in these Terms and Conditions affects your statutory rights as a consumer.
